I think he is the prisoner from set 3859 - Pirate's Prison Tower in disuise ;)

At PlaymoDB there is a way to find figures by specifying just a few details. It's the "Who's That Klicky?" feature on the main page.

I was pretty certain this figure was a pirate but couldn't remember which set it was from, so I put in "Male" for Sex, "Fat" for Torso Style, and "Yellow" for Torso Colour on the search.

The first one in the search results is the figure you're looking for.
